On March 2, 2021, the Secretary of State Anthony Blinken, dealt a hammer blow to many Trans-Atlantic businesses, by rescinding the previous national interest determination regarding categories of travelers eligible for exceptions under Presidential Proclamation 10143. This Proclamation allowed a single entry to the US, directly from UK, Ireland and the Schengen Area for certain technical experts, specialists, senior-level managers, executives, treaty-traders, treaty investors and professional athletes. These travelers were granted an exception in the furtherance of retaining and creating American jobs, whilst assisting with the US economic recovery from the COVID-19 pandemic and bolstering key components of the transatlantic relationship. This exception has been a lifeline to Trans-Atlantic businesses, whose investment, output and supply chains, have been hugely damaged by the pandemic.

The Department of State has confirmed, it will continue to grant NIEs for qualified travelers seeking to enter the United States for purposes related to humanitarian travel, public health response, and national security, only. This criterion is significantly narrower than the previous determination and will cause serious, if not irreparable damage to Trans-Atlantic businesses.
